Within Monongalia County, there are
companies that use hazardous chemicals in the operation of their businesses.
These businesses are called "Covered Facilities" and are required to report
the amounts, locations and potential hazards of hazardous chemicals being
produced, used or stored to the LEPC,
State Emergency Response
Commission [SERC] and the fire department(s) serving that facility.
Under the Federal Superfund Amendment &
Reauthorization Act of 1986 [SARA Title III] owners of facilities, by law,
must take certain actions regarding hazardous substances on their property.
If you use, store, manufacture, process or import any chemical or chemical
substance that is hazardous; you may be subject to the requirements of this
law requiring the completion of the
Tier II
Emergency & Hazardous Chemical Inventory Form. Those facilities that
are subject to the requirements of this law are required to complete the Tier
II reports, which are due March 1st to the following organizations:

Are you submitting Tier II reports
required under Section 312 of the Emergency Planning and Community
Right-to-Know Act (EPCRA)? We have available a software program to help
you organize and expedite that process.
The Tier2 Submit software contains all the appropriate data
fields of information required under EPCRA; prompts you to submit any
additional information required by specific States, but not required by
regulation; and, allows you to validate the report, and prepare it for written
or electronic submission.
Note that not all States are accepting this new software.

The LEPC and SERC must make this
information available to the public upon request [please see the LEPC's
By-Laws for instructions]. LEPC's have the
authority to request additional information from facilities for their own
planning purposes or on behalf of others and can take civil actions against
facilities if they fail to provide the information required under the Act [H.B.
2382].
